Welcome to Inspiration Animation! These Terms and Conditions ("Terms") govern your use of our website and services (collectively, the "Service"). By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Description of Service

Inspiration Animation provides a personalised digital entertainment service. Users can upload a photograph of a child ("User Content") to our platform. Our proprietary technology uses this photograph to create an animated likeness of the child. This animation is then integrated into one of our pre-made, themed video stories ("Generated Video"). Our library of stories includes a variety of themes, such as superhero adventures, becoming a doctor for a day, exploring space, and more.

2. User Accounts

To use our Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

3. User-Generated Content (UGC) and Rights You Grant to Us

3.1. Ownership of Your Content

You retain full ownership of the original photograph(s) you upload to the Service. We claim no intellectual property rights over your User Content.

3.2. License to Us

By uploading a photograph, you grant Inspiration Animation a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, and create derivative works from your User Content. This license is granted for the sole and express purpose of creating your Generated Video and providing the Service to you.

3.3. Your Representation and Warranty

You represent and warrant that:

• You are the parent or legal guardian of the child depicted in the photograph, or you have obtained explicit, verifiable consent from the parent or legal guardian.
• You have the full legal right and authority to upload the photograph and to grant us the license described in Section 3.2.
• The User Content does not infringe upon the privacy rights, publicity rights, copyrights, or other intellectual property rights of any third party.

4. Data Protection and Privacy

Your privacy and the protection of children's data are of the utmost importance to us. Our practices are designed to be compliant with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Please see our full Privacy Policy for detailed information.

4.1. Data We Collect

To provide the Service, we collect the following personal data:

• Your name and email address for account management and communication.
• The photograph(s) you upload.
• Optionally, you may provide a date of birth for the child for the purpose of sending birthday reminders and special offers. Provision of this data is not mandatory.

4.2. How We Use Your Data

Your data is used exclusively to create the Generated Video, manage your account, process payments, and communicate with you about your order and our Service.

4.3. Data Deletion Policy

The original photograph you upload will be permanently deleted from our active systems immediately after your first Generated Video has been successfully created and delivered. We do not store original photos beyond this point. Anonymised animation data may be retained for service improvement purposes.

5. Intellectual Property

5.1. Our Intellectual Property

All aspects of the Service, excluding User Content, are the exclusive property of Inspiration Animation. This includes, but is not limited to, the pre-made video stories, characters, animation styles, software, website design, text, graphics, and logos.

5.2. Your License to the Generated Video

The ownership of the final Generated Video is determined by your purchase type:

• One-Time Purchase: Upon a one-time purchase, we grant you a perpetual, non-exclusive, worldwide, personal, non-commercial license to use, reproduce, and share the Generated Video for personal entertainment purposes only. You may not sell, re-license, or use the Generated Video for any commercial purpose.
• Subscription: For as long as you maintain an active subscription, we grant you a non-exclusive, worldwide, personal, non-commercial license to access, use, and share any Generated Videos created during your subscription period. If you cancel your subscription, this license will remain in effect for all videos created and paid for during the active subscription term.

6. User Conduct and Prohibited Content

You agree not to use the Service to upload, post, or transmit any User Content that:

• Is unlawful, harmful, threatening, abusive, defamatory, obscene, or pornographic.
• Depicts nudity, violence, or any form of child exploitation.
• Violates the privacy or intellectual property rights of any person or entity.
• You do not have the legal right to share.

We reserve the right, but not the obligation, to review and remove any User Content that violates these Terms, at our sole discretion.

7. Payments, Subscriptions, and Refunds

7.1. Billing

We offer both one-time purchases and recurring subscriptions. For subscriptions, you will be billed in advance on a recurring and periodic basis (e.g., monthly or annually). Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your account settings.

7.2. Payment Terms

You agree to provide current, complete, and accurate purchase and account information. All payments are processed through a secure third-party payment processor.

7.3. Refund Policy

Due to the personalised and digital nature of our product, all purchases are final and non-refundable, except where required by law or at our sole discretion.

8. Termination

You may terminate your account at any time by contacting us or through your account settings.

8.2. Termination by Us

We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, if you breach these Terms.

9. Disclaimers and Limitation of Liability

9.1. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Inspiration Animation makes no warranties, express or implied, regarding the quality, suitability, or accuracy of the Service or the Generated Videos. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9.2. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Inspiration Animation, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service. Our total liability to you for any and all claims arising out of your use of the Service is limited to the amount you have paid to us in the twelve (12) months preceding the claim.

10. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of England and Wales to resolve any legal matter arising from these Terms.

11. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
